By accessing or using Rentally ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Description of Service
Rentally is a property management platform designed to help landlords in New Zealand manage their rental properties. The Service includes:
- Rent tracking and payment recording
- Tenant information management
- Property inspection record-keeping
- Healthy Homes compliance tracking
- Tax expense tracking and receipt scanning
- Informational tools regarding potential notice eligibility under the Residential Tenancies Act 1986
- Document and notice generation
3. No Legal Advice
THE SERVICE DOES NOT PROVIDE LEGAL ADVICE. All information provided by Rentally, including but not limited to:
- Calculations regarding rent arrears and overdue days
- Suggestions about which legal notices may be available
- Information about strike counts and the "three strikes" process
- Template notices and documents
- Information about Healthy Homes Standards compliance
- Information about the Residential Tenancies Act 1986

5. User Responsibilities
By using Rentally, you acknowledge and agree that:
- You are solely responsible for all decisions and actions you take based on information from the Service

- You will comply with all applicable laws, including the Residential Tenancies Act 1986 and Privacy Act 2020

- You will not misuse the Service to harass, discriminate against, or unlawfully evict tenants
6. AI-Powered Features
Rentally uses artificial intelligence for certain features, including receipt scanning and optional behavior categorization. You acknowledge that:
- AI-generated content may contain errors or inaccuracies
- You are responsible for reviewing and verifying all AI-generated information
- AI suggestions regarding legal matters are not legal advice
- AI features are provided "as is" without warranty
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY NEW ZEALAND LAW:
- Rentally shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
- Rentally shall not be liable for any losses or damages arising from:
- Your reliance on any information provided by the Service
- Any legal action you take or fail to take based on the Service
- Any notices issued or not issued using the Service
- Any Tenancy Tribunal applications or outcomes
- Loss of rental income or property damage
- Disputes with tenants
- Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability shall be limited to the greatest extent permitted by law.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of any information
- Uninterrupted or error-free operation
We do not warrant that the Service will meet your specific requirements or that any results obtained will be accurate or reliable.
9. Indemnification
You agree to indemnify, defend, and hold harmless Rentally and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including tenants' rights
- Any legal action you take based on information from the Service
- Any notices you issue or actions you take as a landlord
10. Subscriptions and Payment
Some features of the Service may require a paid subscription. By subscribing:
- You agree to pay all fees associated with your subscription plan
- Subscriptions automatically renew unless cancelled before the renewal date
- Fees are non-refundable except as required by New Zealand consumer law
- We may change pricing with 30 days' notice
11. Termination and Account Deletion
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the Service will immediately cease
- You may request an export of your data within 30 days
- We may delete your data after a reasonable retention period
Account Deletion: You may delete your account at any time from the Settings page. Upon deletion:
- Your subscription will be cancelled immediately with no refund
- All your data — including properties, tenants, payment records, notices, inspections, and expenses — will be permanently and irreversibly deleted
- This action cannot be undone and no grace period applies
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.
13. Consumer Guarantees Act
If you are using the Service for business purposes, the Consumer Guarantees Act 1993 does not apply. If you are using the Service for personal use, nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after any changes constitutes acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
